1. The highest bidder shall be the purchaser if the Auctioneer accepts the bid by the fall of the hammer.

2. Should any dispute arise between two or more bidders, the lot shall be immediately put up again for

sale or the dispute may be determined by the Auctioneer whose decision shall be final.

3. The seller expressly reserves the right to bid.

4. Lots are at the risk and expense of the purchaser on the fall of the hammer. The Auctioneer will not

be liable to the purchaser for the death of any animal or loss of or injury or damage to any animal

while in the custody or control of the Auctioneer and whether caused by the negligence of the

Auctioneer.

5. The purchase price shall be paid to the vendor in full in cash on the fall of the hammer. Unless

otherwise agreed by the Auctioneer, no lot shall be delivered to the purchaser prior to full payment

in cash.

6. Property in the lot shall not pass to the purchaser until payment in full of the purchase price.

7. All lots sold with their engagements if any. The purchaser shall indemnify the seller against the

payment of any forfeits.

8. The purchaser acknowledges that he/she has inspected the lot sold and that he/she buys in reliance

upon his/her own judgment and not upon any condition warranty or representation made by or on

behalf of the seller.

9. No condition warranty or representation is given by the seller or the Auctioneer as to description

quality fitness or otherwise and any condition or warranty provided or implied by law or custom to

the contrary is negatived and excluded. Notwithstanding any affirmation made by the seller or

Auctioneer at the time of sale or otherwise, no condition warranty or representation shall apply

unless reduced to writing and signed by the seller or Auctioneer as the case may be

10. No error or misdescription shall vitiate the sale.

11. If the purchaser fails to comply with any of these conditions or if any cheque given to the Auctioneer

or seller is dishonoured any deposit paid shall be forfeited and the seller or the Auctioneer may

without prejudice to any other remedy sue for the balance of the purchase price or without notice to

the purchaser resell the lot in any manner and upon such terms and conditions as may be thought

fit in which case the purchaser shall be liable for the amount if any by which the price falls short of

the purchase price plus expenses and charges in connection with such resale.

12. Unless otherwise agreed by the Auctioneer the purchaser shall be the principle obligor

notwithstanding that he/she is acting as agent for a disclosed or undisclosed principal.

13. Starting price on all lots will be not less than $100.00.
